The DOL has finalized a new rule for the classification of Employees vs Independent Contractors, which will be published tomorrow (January 10, 2024) and will take effect on March 11, 2024. Going forward, employers should utilize all six factors below (giving no one more or less weight than any of the others) and not just the previous two core factors from the 2021 rule which focused on control over the work and opportunity for profit or loss. - The degree to which the employer controls how the work is done. - The worker’s opportunity for profit or loss. - The amount of skill and initiative required for the work. - The degree of permanence of the working relationship. - The worker’s investment in equipment or materials required for the task. - The extent to which the service rendered is an integral part of the employer’s business. https://buff.ly/3vuXb2x
